THE CLUB SPECIAL CONDITIONS FOR THE USE OF SERVICES

1. GENERAL PROVISIONS
1.1. These Special Conditions for the Use of Services (hereinafter the Special Conditions) govern the use of specific Services and Additional Services offered by The Club.
1.2. The Special Conditions form an inseparable part of The Club's Terms of Use of the Service and the Terms of Sale.
1.3. On matters not governed by the Special Conditions, the Terms of Use of the Service, the Terms of Sale and applicable law apply.
2. STORAGE SOLUTIONS
2.1. The following terms are used in these Special Conditions:
Wardrobe locker – a locker in the changing room intended for use during a Club visit;
Safety locker – a freely available locker for storing personal belongings during a Club visit;
Personal locker – an Additional Service that grants the Club Member the right of use to a specific locker in accordance with the conditions of the Service;
Personal wardrobe locker – a personal wardrobe locker accompanying a Signature membership.
2.2. Wardrobe lockers and safety lockers are intended only for the duration of a Club visit.
2.3. Wardrobe lockers and safety lockers may not be used for long-term storage or occupied at times when the Client is not using the Services.
2.4. The Club has the right to apply technical usage restrictions to wardrobe lockers and safety lockers, including the automatic or manual resetting of digital locks.
2.5. The Club has the right to open a wardrobe locker or safety locker if:
the right of use has ended;
items have been left in it after the end of the Club visit;
the locker is being used contrary to its intended purpose.
In such a case, The Club has the right to remove the items left in the locker and to store them for a reasonable time.
2.6. The restrictions set out in this chapter do not apply to a personal locker or personal wardrobe locker to the extent that the conditions of those Services provide for a permanent right of use.
2.7. The Club has the right to open a personal locker or personal wardrobe locker for its maintenance, servicing, the provision of laundry services or other related Services, the elimination of technical faults, ensuring safety or for another justified purpose.
3. SINGLE VISIT
3.1. A single visit grants the right to one Club visit.
3.2. A single visit is valid for ninety (90) days from the time of purchase.
3.3. An unused single visit expires at the end of the validity period.
4. TEN-VISIT PACKAGE
4.1. A ten-visit package grants the right to up to ten (10) visits.
4.2. The package is valid for ninety (90) days from the time of purchase.
4.3. Unused visits expire at the end of the validity period.
5. GUEST PASSES
5.1. A guest pass is a chargeable one-time right of visit that allows a guest designated by the Club Member to use The Club's Services together with the Club Member in accordance with the applicable conditions.
5.2. Guest passes may be purchased by Club Members with a Core, Flex or Signature membership.
5.3. A Club Member has the right to purchase guest passes up to two (2) times per calendar month.
5.4. Within a single order, a Club Member may purchase up to three (3) guest passes, each of which must be linked to a different guest.
5.5. The Club may provide a Club Member with a Signature membership up to two (2) free guest passes per calendar month. The Club has the right to change the volume, conditions or procedure for providing free guest passes, or to discontinue providing them.
5.6. When purchasing a guest pass or using a free guest pass, the Club Member enters the name of each guest and confirms that the guest is at least fourteen (14) years of age.
5.7. The Club Member remains responsible for the guest registered by them throughout the guest's stay at The Club.
5.8. A guest pass is personal and is valid only for the guest designated by the Club Member.
5.9. A guest pass is valid on the day of purchase and its use is limited to The Club's applicable opening hours.
5.10. The Club Member forwards to the guest the access right necessary to use the guest pass via a communication channel or technical solution of their choice.
5.11. The use of a guest pass requires the Club Member to be at The Club at the same time as the guest.
5.12. The Club has the right to establish additional technical or organisational conditions for the use of guest passes.
6. GROUP TRAINING
6.1. Group Training sessions are training sessions organised or intermediated by The Club, participation in which may be chargeable.
6.2. The Club publishes the Group Training sessions available for participation in the App or in the web environment accessible to a logged-in user.
6.3. Registration for a Group Training session takes place in the App or via the web environment accessible to a logged-in user.
6.4. Registration for a Group Training session is possible up to two (2) hours before the start of the training.
6.5. A Group Training booking can be cancelled up to three (3) hours before the start of the training.
6.6. If a Group Training session is full, the Client may join a waiting list.
6.7. When a place becomes available, the next person on the waiting list is notified via the App.
6.8. A booking offer made to a Club Member on the waiting list when a place becomes available does not automatically create a booking. A place is deemed booked after it has been confirmed by the Club Member.
6.9. Through the waiting list, it is possible to obtain a place up to two (2) hours before the start of the training.
6.10. The Club does not guarantee the continued availability of a specific Group Training session, trainer or training format.
7. MEETING ROOMS
7.1. The Club may allow Club Members to use meeting rooms in accordance with these Special Conditions.
7.2. The right to book meeting rooms belongs to Club Members with a Core, Flex or Signature membership.
7.3. Users of a single visit and a visit package may use available meeting rooms without the right to book in advance.
7.4. The availability, bookings and usage times of meeting rooms are displayed in The Club's App or in the web environment accessible to a logged-in user.
7.5. Meeting rooms can be booked up to fourteen (14) days in advance.
7.6. A Club Member may have up to two (2) active future meeting room bookings at a time.
7.7. Once one active booking has been used or has ended, the Club Member may make a new booking in accordance with these conditions.
7.8. The minimum booking duration for a meeting room is thirty (30) minutes.
7.9. The maximum booking duration for a meeting room is two (2) hours.
7.10. The right to book a meeting room is personal and may not be transferred to third parties.
7.11. A Club Member has the right to cancel a meeting room booking up to three (3) hours before the start of the booking.
7.12. The Club generally does not apply a fee or contractual penalty for unused or late-cancelled meeting room bookings.
7.13. Meeting rooms are intended to be used in good faith and with consideration for the interests of other Club Members.
7.14. If a Club Member repeatedly books meeting rooms without using them or repeatedly fails to cancel bookings in time, The Club has the right to restrict or suspend the right to book meeting rooms.
7.15. A person participating in the use of a meeting room must have a valid right to be on the Club premises.
7.16. Unbooked and unused meeting rooms may also be used for a short time without a prior booking.
7.17. A valid booking grants the holder of the booking priority for using the relevant meeting room during the booking.
7.18. The Club may change the number of meeting rooms, the usage procedure, booking rules or usage restrictions in accordance with the development of the Services and the needs of the Club.
8. BATHROBE RENTAL
8.1. The Club may allow Clients to use a bathrobe as a chargeable Additional Service.
8.2. Bathrobe rental may be:
a one-time rental for the duration of a specific visit; or
a monthly-fee-based Additional Service.
8.3. When activating the right to use a bathrobe, the Client may open the cabinet intended for dispensing bathrobes located in The Club's self-service area via the App or another electronic solution enabled by The Club.
8.4. A bathrobe used under a one-time rental or a monthly-fee-based bathrobe rental must, after use, be placed in the laundry basket designated for this purpose by The Club.
8.5. After the return of the bathrobe, The Club provides the Client with a clean bathrobe on the next occasion of use in accordance with the active Service.
8.6. The bathrobe remains the property of The Club throughout the period of use.
8.7. The bathrobe must be used with due care and in accordance with its ordinary intended use.
8.8. The more detailed conditions of use for bathrobe rental may depend on the chosen Service or Additional Service.
9. TRAINING CLOTHES LAUNDRY SERVICE
9.1. The Club may provide Club Members with a training clothes laundry service as a separate Additional Service or as a benefit related to the membership.
9.2. The laundry service is intended for the washing of ordinary training clothes.
9.3. To use the laundry service, the items requiring washing must be placed in the personal laundry bag designated for this purpose by The Club and handed over in the manner determined by The Club.
9.4. The Club Member is responsible for ensuring that the pockets of the items given for washing are empty and that the items do not contain any extraneous objects.
9.5. The Club is not liable for the loss of or damage to money, documents, keys, electronic devices, headphones, jewellery or other extraneous objects left in the laundry.
9.6. The Club has the right to refuse to wash items that do not correspond to the ordinary purpose of the laundry service, including:
footwear;
woollen items;
items requiring special care;
heavily soiled items;
other items unsuitable for the laundry service.
9.7. The Club generally returns the items given for the laundry service within twenty-four (24) hours after their proper handover.
9.8. Items given for the laundry service are generally returned to the Club Member's personal locker, personal wardrobe locker or in another manner determined by The Club.
9.9. The Club is liable only for damage caused by The Club's intentional action or gross negligence to the extent that the limitation of liability is permitted by law.
10. PERSONAL LOCKER
10.1. A personal locker is a chargeable Additional Service that grants the Club Member a permanent right of use to a chosen locker.
10.2. A personal locker is available to Club Members with a Core and Flex membership, subject to the availability of free lockers.
10.3. The personal locker service includes the training clothes laundry service.
10.4. For the first-time setup of a personal locker, the Club Member contacts a member of The Club's staff.
10.5. The Club Member may choose a personal locker subject to the availability of free lockers.
10.6. The Club sets up the chosen locker for use and allows the Club Member to set a personal access code.
10.7. The Club Member is responsible for the confidentiality and use of their access code.
10.8. The right to use the locker is personal and is not transferable to third parties.
10.9. A personal locker is intended for storing the Club Member's training clothes, training equipment and other ordinary personal belongings.
10.10. Lockers to which no active personal locker right of use applies may be usable as ordinary temporary-use safety lockers in accordance with the usage procedure enabled by The Club.
10.11. Items given for the laundry service are generally returned to the Club Member's personal locker.
10.12. Upon the end of the personal locker Additional Service, the right to use the locker ends at the end of the paid billing period.
10.13. The Club Member must vacate the locker no later than the end of the last day of the right of use.
10.14. If the locker has not been vacated upon the end of the right of use, The Club has the right to remove the items left in the locker and to store them for a reasonable time.
11. SIGNATURE MEMBERSHIP SPECIFICS
11.1. A Signature membership is a limited-availability membership that, in addition to the core services and the rights described in the membership package, includes additional comfort and service elements.
11.2. The exact content, benefits and conditions of use of the Signature membership are published in The Club's official information channels.
11.3. A Signature membership comes with a personal wardrobe locker.
11.4. The right to use the personal wardrobe locker is valid only during an active Signature membership.
11.5. For the first-time setup of a personal wardrobe locker, the Club Member contacts a member of The Club's staff.
11.6. The Club Member may choose a personal wardrobe locker subject to the availability of free lockers.
11.7. The Club sets up the chosen wardrobe locker for use and allows the Club Member to set a personal access code.
11.8. The Club Member is responsible for the confidentiality and use of their access code.
11.9. The right to use the personal wardrobe locker is personal and is not transferable to third parties.
11.10. Within the Signature membership, The Club provides the Club Member with additional benefits and services, including the use of a personal wardrobe locker, bathrobe, sauna towel, laundry bags, slippers and other benefits related to the Signature membership.
11.11. On the first visit, the Club Member may choose the location of the personal wardrobe locker subject to availability, and the items and services related to the Signature membership are prepared for their use as soon as possible.
11.12. The procedure for the use, return, replacement and other more detailed handling of the items, services and benefits related to the Signature membership is determined by The Club.
11.13. If the Club Member wishes to have the bathrobe or sauna towel washed or replaced, the relevant item must be placed in the laundry basket designated for this purpose by The Club.
11.14. If the bathrobe or sauna towel is left in the personal wardrobe locker after use, The Club generally treats this as a sign that the Club Member does not wish to have it washed or replaced before the next visit.
11.15. A Signature membership includes the training clothes laundry service.
11.16. When using the laundry service, the provisions of these Special Conditions governing the training clothes laundry service apply.
11.17. A personal wardrobe locker is intended for storing the Club Member's training clothes, training equipment and other ordinary personal belongings.
11.18. Upon the end of the Signature membership, the right to use the personal wardrobe locker also ends.
11.19. The Club Member must vacate the personal wardrobe locker no later than the end of the last day of the membership.
11.20. If the wardrobe locker has not been vacated upon the end of the membership, The Club has the right to remove the items left in it and to store them for a reasonable time.
11.21. Upon the end of the Signature membership, the Club Member does not retain the right to a specific wardrobe locker. In the case of later rejoining, the possibility of using the same wardrobe locker depends on the availability of free lockers.
11.22. The Club has the right to change the services, benefits, usage procedure and organisational solutions included in the Signature membership, provided that the general nature and value proposition of the membership do not significantly diminish.
12. THE CLUB'S PROPERTY
12.1. The Club may allow a Club Member or Client to use various items and equipment belonging to The Club, including:
bathrobes;
sauna towels;
training towels;
slippers;
laundry bags;
training equipment;
other items issued for the use of the Services or to ensure comfort.
12.2. The items referred to in this chapter remain the property of The Club unless The Club has expressly provided otherwise.
12.3. The Club's property is intended for use on the Club premises or in the manner set out in the Service description.
12.4. The Client undertakes to use The Club's property with due care and to return it after use or upon the end of the right of use in the manner determined by The Club.
12.5. If The Club's property is damaged or destroyed intentionally or through gross negligence, The Club has the right to demand compensation for the damage caused in accordance with the law.
12.6. Wear and tear resulting from ordinary use is not considered damage.
13. FINAL PROVISIONS
13.1. These Special Conditions for the Use of Services form an inseparable part of The Club's Terms of Use of the Service and the Terms of Sale.
13.2. On matters not governed by these Special Conditions, the Terms of Use of the Service, the Terms of Sale and applicable law apply.
13.3. The Club has the right to change, supplement and update these Special Conditions in accordance with the development of the Services, technical solutions, business needs and requirements arising from legislation.
13.4. Changes to the Special Conditions for the Use of Services are published in The Club's official information channels.
13.5. These Special Conditions for the Use of Services enter into force upon their publication or on the date determined by The Club.
13.6. This document has been drawn up in Estonian. In the event of a conflict between translations and the Estonian-language version, the Estonian-language version prevails.
